By accessing or using the SwifTrack platform, you agree to be bound by these Terms of Service and all applicable laws and regulations. If you do not agree with any of these terms, you are prohibited from using or accessing this platform. These terms apply to all visitors, users, and customers of SwifTrack.

2. Use of Services

SwifTrack grants you a limited, non-exclusive, non-transferable license to use our platform for lawful logistics and shipment tracking purposes. You agree not to:

• Use the platform for any unlawful purpose or to solicit others to perform unlawful acts
• Violate any international, federal, provincial, or state regulations, rules, laws, or local ordinances
• Transmit any material that is defamatory, offensive, or otherwise objectionable
• Attempt to interfere with, compromise, or disrupt the platform or its infrastructure

3. Account Responsibilities

When you create an account with us, you must provide accurate and complete information. You are responsible for:

• Maintaining the confidentiality of your account credentials
• All activities that occur under your account
• Notifying us immediately of any unauthorized use of your account

4. Shipment and Liability

SwifTrack provides a logistics tracking and management platform. We are not a carrier and do not physically handle shipments. Our liability is limited to the proper functioning of our platform. Claims for lost, damaged, or delayed shipments should be directed to the applicable carrier. SwifTrack's total liability shall not exceed the fees paid for the services in the preceding 12 months.

5. Intellectual Property

The SwifTrack platform, including its original content, features, functionality, logos, and design elements, is and remains the exclusive property of SwifTrack Inc. and its licensors. Our platform is protected by copyright, trademark, and other intellectual property laws. You may not reproduce, distribute, or create derivative works without our express written permission.

6. Service Availability

We strive to maintain high availability but do not guarantee uninterrupted access to our platform. We reserve the right to modify, suspend, or discontinue any part of our services with or without notice. We shall not be liable for any modification, suspension, or discontinuation of services.

7. Limitation of Liability

To the maximum extent permitted by applicable law, SwifTrack shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, use, or goodwill, arising from your use of the platform.

8. Governing Law

These terms shall be governed by and construed in accordance with the laws of the State of New York, United States, without regard to its conflict of law provisions. Any disputes arising from these terms shall be resolved in the courts located in New York County, New York.
